Can we declare a child born following an IMG?

The IMG takes place before 22 weeks of gestation

Since 2008, the law has allowed parents, who so wish, to declare their baby to the civil status and register it in the Family Book (only the “death” part is completed).

How? ‘Or’ What ? The maternity ward gives the couple a birth certificate, stating that the child was born following a medical termination of pregnancy. This document allows them to obtain, from the town hall, a certificate of a child born without life.

The parents declare their baby to the civil registry and obtain a certificate of a child born without life. It is then mentioned in the Family Book (only the “death” part is completed).

Unmarried couples, of whom it is the first child, can request the issuance of a Family Booklet upon presentation of the certificate of a child born without life.

What about the funeral?

If the family obtains a certificate of a child born without life, the organization of a funeral is quite possible. The couple must contact their municipality.

Can a woman who has undergone an IMG benefit from her maternity leave?

If the medical termination of pregnancy occurs before 22 weeks of amenorrhea, the doctor can establish a sick leave. Beyond this period, the mother will be able to benefit from her maternity leave and the father from her paternity leave.
