Sick leave certificate 2016: how they calculate

The deputies propose to pay a certificate of temporary disability in the amount of 100% of earnings to those who catch the flu and SARS. For seniority, the employee is recommended to close his eyes. As long as the decision is made, the old rules apply. Let us recall the procedure for settlements with today’s patients.

The calculations take into account the years that the employee has worked. The period of service under an employment contract matters, and some other periods are also taken into account, in particular, maternity leave and parental leave.

The allowance is defined as follows:

– with an experience of up to 5 years, sick leave is equal to 60% of the average earnings;

– with work experience from 5 to 8 years – 80% of the average earnings;

– with work experience of 8 or more years – 100% of the average earnings.

To determine the size of the allowance, all “white” payments are taken into account: bonuses, allowances, fees. However, there is a nuance: they take the average earnings for the last two years preceding the year of sick leave. That is, for those who draw up a certificate of incapacity for work now, earnings for 2014 and 2015 are relevant.

This amount is divided by 730 (the total number of days in two years) to determine the average daily income. Then it is multiplied by a percentage depending on the length of service – 60, 80 or 100%. The resulting figure is multiplied by the number of days indicated in the sick leave.

There is a “ceiling” in the legislation: the maximum amount of temporary disability benefits in 2016 could be 1772,6 rubles. in a day. If, after the calculations, the average daily earnings turn out to be more than this limit, then for one day of illness, even with more than 8 years of experience, you will receive a maximum of 1772,6 rubles.

In practice, the limitation is important for those whose average salary in the past two years was above 53,9 thousand rubles. – this is now the maximum sick leave per month.

If the income was less, which means that the average daily was lower or equal to 1772,6 rubles, then the benefit will be calculated according to the real size of the salary. With work experience, for example, up to 5 years, you will receive 60% of your actual average earnings, having worked for 8 or more years – all 100%.

By the way, if there were periods of unemployment in the previous two years, then after calculations the average daily earnings may turn out to be scanty. After all, the amount of official income for this period will be divided by 730. The rule softens the blow a little: sickness benefit cannot be lower than the minimum wage established in Russia (minimum wage). From January 1, 2016, the minimum wage is 6204 rubles. per month.

In case of outpatient treatment (at home), the first 10 days are paid to the parent as in case of their own illness. From the 11th day, the payment is reduced and amounts to 50% of the parent’s average earnings. If the child is admitted to the hospital and the parent is there with him, the benefit is paid for all days as in case of his own illness.

Limitations on child benefits

The length of the sick leave depends on the age of the child:

– for a child under 7 years old – the parent is paid up to 60 calendar days a year;

– a child from 7 to 15 years old – for each case of the disease, an allowance is allowed for up to 15 calendar days, but not more than 45 days a year;

– son or daughter over 15 years old – paid for up to 7 calendar days on each occasion and a maximum of 30 days a year.

There is an exception. In case of illness of a disabled child under 15, the parent is paid up to 120 days of sick leave per year.

IMPORTANT!

The restrictions are applied to each of the parents separately, explains the Social Insurance Fund of the Russian Federation (this department is responsible for paying sick leave). For example, if the mother of an 8-year-old child has exhausted the 45-day payment limit, then the father can continue to take sick leave.
