Neighbors are building a house a meter away from our fence. Are there any restrictions on site planning now?

If the Neighbors persist and continue to work, you have the right to sue them. The fact is that there are sanitary standards (SNiP 30-02-97). They are installed for garden and suburban areas. This document regulates the distance between buildings. For example, your neighbor can build a house no closer than 3 meters from the fence. Please note that if at the wall of the house facing your site, there is some element protruding more than 50 cm (veranda, balcony, canopy), then the required distance should be measured from this part.

There is a separate rule for tall trees that give shade. They are planted at a distance of 4 m from the fence, and low-growing trees – at an interval of 2 m from the fence. If a neighbor does not respond to comments, contact the board, at its meeting a decision will be made, it will be in your favor. The troublemaker will be forced to make changes.

Is it possible to put a blank fence on the border of your summer cottage?

Deaf fences can be installed only on the side of the site that borders the street or forest. But between two garden estates, it is supposed to erect a fence with a height of no more than 1,5 m. The ideal material is a chain-link mesh. Neighbors can divide the plots with a blank fence, but they can do this only by agreement. By the way, many summer residents do just that. At the same time, they divide the cost of erecting the fence in half.

A neighbor took up poultry farming and placed a chicken coop next to our house. How to get him to move the shed?

Take a tape measure and take measurements. Check how far the chicken shed is from your fence. If it is less than 4 m, write a statement to the court. But first, talk to your neighbor again, explain that he violates sanitary standards. Refer to SNiP 30-02-97.

Is it possible in a garden partnership to build a large house with a garage and a sauna? Do I need to get a separate permit?

If we are talking about construction on a summer cottage, you do not need to obtain a permit. The main thing is that you are the owner of the land. Make a plan of the buildings, be sure to choose the right places for them. They should not run counter to sanitary standards. For example, the distance from the neighboring plot to the garage may be at least 1 m. By the way, there are also rules for internal planning. So, the minimum interval between a residential building and a bathhouse or toilet is 8 m. If you act according to sanitary standards, your neighbors will simply have nothing to complain about. When all structures are ready, draw up a declaration (the form can be taken from Rosreestr). Indicate in the document all the objects that are on your site.

A neighbor moved the fence and took over part of our site. How to get him to return the land?

It is good if you have done land surveying. It defines the boundaries of the site, the data is entered into the cadastre. In this case, you can take an extract from Roseestre with a graphic image of the site. With this document, you must contact the land inspector (in the same Roseestre). He will visit your property for verification. If the violation is proven, the invading neighbor will be brought to administrative responsibility. If land surveying has not been done, it will have to be done. Please note that the cadastral engineer will carry out the procedure in the presence of neighbors. They must be called.
