The mother of an infected newborn baby sued the hospital. The court issued the verdict

In the hospital in Słupecki, a newborn was infected with staphylococcus. The child’s mother instituted a treatment lawsuit. Just before Christmas, the court issued a verdict, not recognizing her claims.

On April 28, 2015, a healthy boy was born in the hospital in Słupca. At the same time, staphylococcal bullous impetigo was diagnosed in the department where the newborn was staying. The neonatal unit was closed on May 1 and the boy was discharged home. Previously, he had a nasal swab taken to check for a staphylococcal infection. Unfortunately, the test result turned out to be positive.

The child’s mother demanded compensation from the hospital in Słupca, which the facility did not recognize. Then the woman, through her representative, filed a lawsuit demanding that the hospital pay PLN 10. PLN compensation. However, the hospital did not scare the lawsuit and did not pay the woman a single zloty, still claiming that it had nothing to complain about in this case.

The verdict in the above case was issued on the basis of an expert opinion of an infectious disease specialist. An infectious disease specialist appointed by the court admitted that the boy had contracted the infection in the hospital, but also found that the management and staff of the facility were acting correctly. – It cannot be concluded that the infection occurred as a result of negligent hygiene in that ward. Despite maintaining all hygienic standards, some situations cannot be avoided – says slupca.pl. According to which the facility is not obliged to pay compensation.
