Sick leave on parental leave: paid or not
Sometimes an employee gets sick, barely waiting for a well-deserved annual rest. In this case, you can issue a newsletter, receive benefits and extend your vacation. With the “decree” things are different. Sick leave on parental leave is not discharged. But there are exceptions to this rule.
After the end of maternity leave, the mother is given the opportunity to take care of the baby for three years. All this time, her work place is kept for her. The payment will be small – only 40% of the average earnings and only until the child is one and a half years old. After reaching this age, they will pay 50 rubles a month. The days spent on sick leave will not increase the duration of the vacation, additional money will not be paid for them. Compensation and disability benefits are not issued for the same period.
Sick leave on parental leave is not issued
The following situation may arise: the mother gets sick a few days before going to work. It will be important here when a certificate of incapacity for work is opened. For example, you have to go to work on December 21, an employee got sick on December 18. In this case, it will be correct to open the sick leave not on the 18th, but on the 21st. A document in which the date of onset of the disease is December 18 will be erroneous. The accounting department will not accept and will not pay for an incorrectly completed sheet. The FSS recognizes it as invalid and will refuse to credit the benefit. Doctors know how to draw up ballots, but may not know that the patient is still on vacation. They should be warned about this in order to avoid misunderstandings.
When sick leave can be paid
There are cases when the mother is paid sick leave:
- Work from home. The law does not prohibit a woman from caring for a child and working at the same time. In this case, all the rights of the worker apply to it. A home worker is issued a certificate of incapacity for work on a general basis.
- Work on a part-time schedule. Just as in the first case, the mother can go on sick leave if she or the child gets sick.
In addition, sick leave can be obtained if the vacation is interrupted. Until the child is three years old, the parent has the right to interrupt and resume vacation, using it not in full, but in parts. The number of such parts is not limited.
Everyone who works is entitled to a temporary disability benefit. During parental leave, a mother can work at home or on a reduced schedule, which means she can count on sick leave. If you had to get sick on the eve of going to work, you need to make sure that the documents are drawn up correctly.
