Rules for registration of suburban buildings: new law 2017

The gardeners are in for trouble. On January 1, the rules for the design of suburban buildings were changed. On the one hand, the dacha amnesty remains, on the other, the procedure for registering property will become more complicated. We find out what the innovations are.

The dacha amnesty is 10 years old. For many, it has become a salvation and has saved time and money when registering the ownership of country houses. It was necessary to draw up a declaration indicating the size of the site, the scale and purpose of the building. Pay the state fee and apply for registration with Rosreestr. But, despite the simplicity of the procedure, more than 40% of the properties remained unregistered, and the summer residents remembered the need to legalize the property only when it came to the transfer of the plot by inheritance or on the eve of the sale. And in vain, because now it has become more difficult to legalize ownership.

For owners of houses located on hundred square meters intended for individual housing construction, the registration situation became more complicated in July 2016. In addition to the technical plan and payment of state fees, they must provide permission for the construction of the facility. It is still easier for summer residents to legalize property. Therefore, before proceeding with the registration, you need to figure out which category of land the site belongs to. You need to go to the site of the cadastral map www. pkk5.rosreestr.ru and find your allotment on it. Then, in the nearest department of Rosreestr, request an extract for the site, indicating its number. The document will contain all the information, including the category of land.

The next step is to obtain an official cadastral plan with the coordinates of the location of the building, which means that you will have to spend money on calling a cadastral engineer. The prices for his work depend on the area of ​​the land, on average it is 7-8 thousand rubles. An engineer can be found in both a private and public organization. But it is important to check his qualifications. This can be done on the website of the Federal Service for State Registration, Cadastre and Cartography in the “Register of Cadastral Engineers” section.

Changes to the registration procedure make it impossible for owners to cheat with paying taxes, because you cannot provide false information about ownership. The cadastral engineer will make his edits. Until recently, many summer residents reported incorrect information about the area of ​​the site and the building. And sometimes they even passed off a full-fledged house for a non-residential object. This allowed the tax to be reduced. Now the plots will begin to be checked, and if the number of acres and square meters of the house turns out to be more than indicated in the documents, the owner will be charged a fine of 20% of the amount of unpaid taxes, which will later have to be paid. A surprise has been prepared for the owners of dummy houses. If the building is recognized as non-residential, then it will not work to connect the water supply and electricity system to it.

The dacha amnesty will be valid until March 1, 2018. Later, in order to register buildings, you will need to obtain permission to put them into operation.
