Responsibility of parents for raising children: law, improper implementation
The responsibility of parents for the upbringing of children is spelled out in law starting from the Constitution of the Russian Federation. The responsibilities of people raising children are regulated by several codes.
Code of Laws Declaring the Responsibilities of Parents
The responsibilities of the parents are enshrined in Part 2, Art. 38 of the Constitution of the Russian Federation, which emphasizes that the father and mother have the same responsibilities for the maintenance and upbringing of children.
In the family code, Art. 63, 62 and 65, the duty of parents to their children is specified. In particular, it is said that parents cannot represent the interests of children when there is a conflict with the interests of the parents.
Parents can be criminally liable under 2 articles of the Criminal Code of the Russian Federation:
- Art. 156 of the Criminal Code of the Russian Federation regulates liability for poor-quality fulfillment of obligations, which is associated with cruelty towards a child.
- Art. 157 of the Criminal Code of the Russian Federation is aimed at punishing non-payment of alimony.
The last article presupposes the arrest of the parent and forced labor as a punishment.
The civil liability of parents is associated with poor performance of their obligations to the child. If inaction, improper care, lack of nutrition or clothing has led to damage to the baby’s health, then according to Art. 151, 1064, 1099 of the Civil Code of the Russian Federation, parents can be held liable. They may be required to compensate for non-pecuniary damage or damages.
Inadequate performance of duties
The Family Code lists options when a child can be removed from a parent. Art. 69 lists the circumstances when parents cannot continue to raise a child:
- if child support is not paid;
- do not take the child from the hospital or other childcare facilities;
- allow child abuse;
- if you have committed a crime against your spouse or child.
The state does not allow alcoholics and drug addicts to bring up children.
Realization of children’s rights through the responsibilities of parents
According to the legislation, a child must receive care, education, physical and moral education. If parents ignore their responsibilities and the child commits an offense, then the parents are responsible. Federal Act No. 436-03, issued in 2010, protects children from information with scenes of violence, cruelty, pornography.
Toddlers should not be shown or allowed to see calls for drugs or alcohol. Parents or guardians who allow this may be subject to administrative liability.
Adequate parents should not be reminded of the measures of responsibility for the child. They would rather be on the safe side than allow the child to suffer.
