Maternity leave – who is entitled to it, how long is it, calculator, application

Are you pregnant and your due date is fast approaching? Check when you can take maternity leave. Find out what formalities must be completed. Maternity leave is an answer to the expectations of future mothers who want to use the first months after giving birth to care for their babies.

Maternity leave is not available to all women, but only to specific groups of people.

The right to maternity leave

In accordance with applicable regulations, maternity leave is intended for women employed under a contract of employment and for persons running a business. In addition, the leave can be used by women employed under a mandate contract – as long as they pay for sickness insurance.

If you want to accurately calculate the duration of the leave and at the same time estimate the amount of the allowance you are entitled to, you can use the maternity leave calculator. It is a tool thanks to which you will know not only the length of leave, but also check the date of return to work. The calculator needs data such as:

  1. start date of leave,
  2. number of children born.

After completing the data, you will receive feedback. This allows you to easily plan your baby’s care.

If you are entitled to it and you have only one child, you can take 20 weeks of basic maternity leave. You can use the 6 weeks before giving birth and the rest after giving birth.

For twins it is extended to 31 weeks. This period is longer if you have triplets (33 weeks), quadruplets (35 weeks) and more than five babies (37 weeks). In addition, 6 weeks of additional maternity leave can be used.

The woman may not waive this privilege, but may return to work earlier – after 14 weeks at the earliest. The condition is, however, that the remaining 6 weeks must be used by the child’s father employed under a contract of employment.

Maternity and parental leave

Parental leave has been in force in Poland since 2013. It gives parents the option of caring for their child for a further period of 32 to 34 weeks – depending on the number of children born. In total, after the birth of a child, 52 weeks can be used (54 in the case of a multiple pregnancy) – i.e. maternal 20 weeks and parental 32 weeks (34 in the case of multiple pregnancy).

Maternity and parental leave enable the mother to look after the baby for a period of 12 months after the birth of the child. For this to be possible, you must use the full-time primary and secondary maternity. It is also important that all types of leave follow one another.

Application for maternity leave – documents

If you want to exercise your right, you should apply for maternity leave. However, this applies to the case where you intend to use some of the leave before the child is born. If you intend to go on maternity leave after giving birth, the employer should receive a birth certificate from the hospital and a child’s birth certificate.

Amount of maternity allowance

For the first 20 weeks, mum receives an allowance of 100%. salary, and later – 60 percent. If she wants to stay with the child for the whole year, mum will receive 80 percent. allowance. If a woman is entitled to an allowance of less than PLN 1000, she will be compensated to this amount.
