I am a teacher, can I get fired for not getting vaccinated?

This summer, the mandatory vaccination of most of our population was announced. At the same time, citizens are increasingly interested in how serious the sanctions will be for those who ignore this decree.

In June of this year, Rospotrebnadzor announced a list of professions whose employees must be vaccinated without fail. Among them were mainly specialists whose activities are directly related to working with people. At the same time, it was first argued that being vaccinated or not was still voluntary. However, doctors tirelessly repeat: workers who are forced to interact with a large number of people simply cannot expose others to infection.

In this regard, many employees of educational institutions have a quite reasonable question – is it possible to still refuse vaccination and can they be fired for this?

It is known that today, according to the Labor Code, no sanctions are provided for refusing to vaccinate. However, every officially employed teacher has a medical book on hand, which must contain all the necessary test results and vaccinations. In addition, current legislation allows the chief regional sanitary doctors to introduce a mandatory vaccination regime in order to prevent the spread of the virus. According to the article of the Federal Law “On Immunoprophylaxis of Infectious Diseases”, preventive vaccinations for epidemic indications are carried out to citizens when there is a threat of infectious diseases.

It turns out that the employer can always suspend an employee from work without pay for an indefinite period. This can be a key lever of pressure on an unvaccinated worker. And here a person is forced to make a choice – to be on long unpaid leave or to be vaccinated.

At the same time, it is precisely the dismissal for refusal of vaccination that is not provided for by the law. Therefore, all kinds of threats from the employer about the possible termination of the work contract in case of refusal to vaccinate is illegal. Lawyers even advise to appeal such incidents in court, although they warn that such claims may be futile. The fact is that compulsory vaccination is a completely new thing not only for Russians, but also for most countries. Obviously, all teachers will have to be vaccinated – it’s only a matter of time.
