The forced vaccination campaign has left a huge number of questions. Finally, the answer to the most acute of them is given.
Denial, anger, despair, reconciliation, acceptance, vaccination. We are willing to bet that if you have not yet received the vaccine, the thought of it still visited you at least once. And how can you not think about an injection when citizens are pushed to the point of vaccination not only by the campaign program, but also by the legislation?
Following Moscow, the regions of Russia started thinking about compulsory vaccination. Many questions immediately arose: can they be fired for refusing to vaccinate, how to file a refusal for it for medical reasons, and, most importantly, how legal is it? On the Internet, they are talking about human rights violations and that it is time to complain to The Hague.
But Russian lawyers argue that compulsory vaccination fully fits into the country’s legislation.
Dmitry Lipin, Deputy Chairman of the Commission for the Protection of Social and Economic Rights of the Association of Lawyers of Russia, notes that human rights in our state do have a priority, but they can be limited in accordance with the Basic Law. It allows, if necessary, to take over the leadership “to the extent necessary to protect the foundations of the constitutional order, morality, health, rights and legitimate interests of others, to ensure the defense of the country and the security of the state.”
Moreover, it is important to understand that the decree on compulsory vaccination was not adopted by Sergei Sobyanin, but by the Chief State Sanitary Doctor for the city of Moscow. And he has all the authority to announce the need for vaccinations – this explains the lawyer Ekaterina Tyagay.
“Formally, the possibility of issuing a relevant resolution is indeed provided for by law – this is Art. 10 Federal Law “On immunization of infectious diseases”. Preventive vaccinations may become mandatory when there is a threat of infectious diseases, the list of which is established by the Ministry of Health, ”says Ekaterina.
Lawyer Dmitry Gorbunov clarifies: for some areas (for example, education and health care), participation in the immunization program remains mandatory. All this is in accordance with the already mentioned federal law, according to which in a normal situation it is possible to refuse such an immunization program, but if the Chief Sanitary Doctor announces a special situation, vaccination becomes a mandatory procedure. Which is exactly what happened.
