What is a garage amnesty

The purpose of the garage amnesty is to enable people to obtain ownership of the land and the building itself in a simplified manner. There will be a document – there will be other rights: to inherit, give, sell and even take a loan of real estate.

There were no documents to prove ownership. Compensation was not always paid – and quite legally: land was handed out for cooperatives in Soviet times, often it was done by enterprises. By the way, the garage amnesty is the popular name of the law. The document itself is difficult to call: “On Amendments to Certain Legislative Acts of the Federation in order to regulate the acquisition by citizens of the rights to garages and land plots on which they are located.”

When did the garage amnesty law come into force?

The document has been in development for two years. It was originally supposed to be launched in 2020. However, in the end, the garage amnesty still came into force in 2021. The new rules came into effect on September 1st.

How to register your garage

To qualify for the amnesty, a garage must meet several requirements.

• A building that stands alone, for example, in a yard or in a garage cooperative. Not temporary, with a foundation. May have common walls, roof with other garages in the same row.
• Built before December 30, 2004. After that, the new Urban Planning Code came into force and garages, as a rule, were registered.
• The garage is located on state or municipal land.
• The land for the garage was provided by an organization such as a cooperative or former employer, or otherwise allocated.
  

The garage amnesty came into force in 2021, and now the owners need to write an application and attach documents that confirm the right to the building and the land under it. There is no single body that would accept applications in Our Country. In one city, this is the department of land relations under the local administration, somewhere the ministry for state property management or the management of land and property relations. Some allow you to apply at the My Documents MFC, where there are windows of the cadastral chamber, others are waiting only for a face-to-face visit to the office.

Officials recognize the stalemate that modern laws have brought Our Country into. If you want to formalize an object, you need rights to the land under it. And if you want to formalize the land, then you need an object.

The law on garage amnesty will just allow you to acquire the right to land and to the garage itself.

• A document on the provision or allocation of a land plot.

• a document confirming the state technical accounting and (or) technical inventory of the garage before January 1, 2013, in which you are indicated as the owner of the garage.

To participate in the garage amnesty, you need a technical plan of the garage.
