Summer residents grow many plants on their plots. And there are regulars – weeds. And few people think that they can cause serious problems. Let’s find out what is forbidden to grow on suburban acres and what it can threaten.
Can they punish parsley
Almost every year, at the beginning of the summer season, frightening reports appear on the Internet that gardeners face fines and even criminal liability for parsley in the garden. And every time in the media there are explanations of lawyers about the cultivation of this very parsley.
So, the list of prohibited plants includes only parsley seeds and essential oil from it – it contains prohibited substances. Greens are not included in this list – they are legal. However, the seeds are not prohibited if you have collected them in order to sow them later.
By the way, parsley seeds are sold in garden centers, and there are no problems. They will punish you only if you start making oil from seeds – then you face liability under article 228 of the Criminal Code (1).
And one more important point – only curly parsley was included in the list, which includes the popular variety Mooskrause 2 (2). But ordinary parsley, with simple leaves, was not included in the list. Namely, it is most often grown in summer cottages.
And what kind of list is this, where parsley is included? And this is SanPin 2.3.2.1078-01 “Hygienic requirements for the safety and nutritional value of food products.” To be more precise – Appendix 5b “Biologically active substances, food components and products that are their sources, which can have a harmful effect on human health when used for the manufacture of biologically active food supplements.” And there is not only parsley – a lot of plants that can be found in any country house. For example, popular trees and shrubs:
- all types of acacia (aerial part);
- all types of barberry (bark and roots);
- thuja (biota) eastern (all parts);
- juniper Cossack (all parts);
- all kinds of rhododendrons.
Garden flowers also got there:
- aconite (all parts);
- periwinkle (all parts);
- serrated buzulnik (all parts);
- all types of aquilegia (all parts);
- all types of delphinium (all parts);
- lily of the valley;
- lobelia;
- all types of hellebore;
- all kinds of foxgloves;
- gaillardia;
- dicenter;
- tobacco.
And from the weeds in this list – celandine.
Do you face fines for weeds on the site? Of course no. SanPiN data is about food safety. That is, if you, for example, registered as an individual entrepreneur or self-employed and bake bread for sale, it should not contain any Cossack juniper seeds, flour from tobacco leaves or curly parsley essential oil. You cannot decorate a cake for sale with periwinkle or aquilegia flowers – such products can poison people. And grow for beauty – yes please!
What is actually banned?
In the same list of SanPiNs, there are also such plants as hemp (all types) and some types of poppy (Armenian, bracts, dubious, golostalny and sleeping pills). But these representatives of the flora are also listed in another list – “List of plants containing narcotic drugs or psychotropic substances or their precursors.” It was established by the government in 2010, and in 2017, 2019 and 2020, additions were made to it. There are few plants in it, and of those that can really survive in the dachas of the middle lane are hemp and poppy. However, there is a clause on the number of bushes – criminal liability under Art. 231 of the Criminal Code of the Federation occurs when it comes to a large and especially large amount (1). That is, if there are more than 20 cannabis bushes, and more than 10 poppy.
By the way, about poppies. In the old days, beautiful poppies grew in every village flower garden, which were popularly called confectionery poppies. It was from them that seeds for buns were collected. But don’t be fooled by the word “confectionery” – this is the soporific poppy (3) from which opium is obtained. Are you at a loss? What about poppy seed buns? After all, they are being sold? Yes, and this is legal, because the SanPiN list says: “all parts of the plant, except seeds.” Seeds can be safely added to food.
But as for cultivation … According to the law, it is allowed to have a maximum of 9 plants of such poppy in a flower garden. But you understand that in modern realities you are taking a very big risk. Almost certainly, a district police officer will get into the habit of going to you and counting the bushes. And God forbid, the tenth bush will sprout somewhere from the seeds that attacked last year (and this is easy) – it is very difficult to prove that you had no intent. Have you watered and weeded the flower garden? So, the poppy was looked after. And this is the intent. Explain that this is for the sake of seeds for buns, and not “smoke opium”, you will already be in court. And you won’t be able to convince anyone.
Can summer residents be punished for weeds
Another horror story that periodically appears on the Internet is fines for weeds on the site.
And indeed: there is Article 10.1 of the Code of Administrative Offenses “Violation of the rules for combating quarantine, especially dangerous and dangerous plant pests, plant pathogens, weed plants” (4), which provides for serious fines for citizens. And there is a decree of the government of the Federation “On the signs of non-use of land plots from agricultural land for the intended purpose” dated September 18, 2020. And it is in it that the weeds are listed, for which they will be punished.
Among them:
- hogweed Sosnovsky;
- dandelion;
- yarrow;
- tansy;
- field mint;
- wormwood;
- show;
- chicken millet;
- styrica;
- succession;
- a shepherd’s purse;
- bottom
That is, in fact, all the weeds from our gardens. They even got vegetable purslane, which summer residents grow for salads, and Canadian goldenrod, a frequent inhabitant of flower beds.
So, are we urgently running to the gardens with a hoe? No. These norms apply only to agricultural land, that is, a fine may threaten, for example, a farmer, the owner of an industrial garden or a plant nursery. The law does not apply to summer residents, because their plots belong to other categories of land – for individual housing construction, personal subsidiary plots or gardening and horticulture. So you can safely return back to your favorite hammock.
