Father’s rights to the child: divorce, seeing, dating, alimony
The rights of the father to the child after the separation of the parents are equal to the rights of the mother, regardless of who the baby is left to live with. It is important for dad to find out in advance everything that he has the right to in the upbringing of his child.
Dating where the father can see the child
The law protects the rights of the dad to see his child even after the break with his wife. To avoid misunderstandings, parents should write a formal agreement. In the agreement, it is necessary to establish when the dad can communicate with the baby (days, months, etc.), it is important to take into account the holidays so that there are no quarrels with whom the baby will spend, for example, the New Year.
Also, the agreement must indicate where the meetings can take place. This could be your apartment or your father’s apartment, a park, a cafe, etc. Finally, you have the right to indicate who can be present at the meetings. For example, you can ask that your ex-husband’s new wife not be present at the meetings.
It is possible to prohibit a meeting between a father and his son or daughter only if he is deprived of his parental rights. This can be done for the following reasons:
- willful neglect of the parent’s responsibilities, including non-payment of alimony;
- abuse of parental rights;
- child abuse;
- addiction to alcohol or drugs;
- the father has committed a deliberate offense against the child or his mother.
If there are no such grounds, then the attempt to deprive the father of parental rights will not be crowned with success, so there is no point in wasting energy and nerves in court.
Father’s other rights after divorce
Here are the basic rights that a father has if he does not live with his family:
- the right to receive information about a son or daughter from a kindergarten or place of study;
- the right to communicate with the child;
- the right to consent or disagree with the export of the baby abroad;
- the right to prohibit or permit a change of surname.
Remember that in addition to rights, the father also has his own responsibilities to the child.
If one of the parents does not live with the child, he is legally obliged to pay maintenance allowance. It can be requested on the basis of parental agreement or on the basis of a court order. The amount, form and period of payments must be specified in the agreement. Please note that the minimum amount of payments for one baby is 1/4 of the salary, for two – 1/3, for three – 1/2.
Parting is a difficult period for a child, so the task of mom and dad is to smooth out the situation as much as possible. In addition, it is very important that each parent gives the child enough attention.
