Children’s rights at school: duties, violation, protection
The rights of the child in school are rarely brought up for family discussion, but in vain. A toddler, whose opinion is taken into account at home, may suffer if faced with obvious injustice in an educational institution.
It is not uncommon for a school to in one form or another fail to fulfill its obligations towards students. The kid may not be allowed to class without a change of shoes. This is contrary to the Law on Education, which does not stipulate suspension from school for this reason. Moreover, the educational institution is responsible for the student and will be responsible for him according to the law if an accident occurs during the return home with the child.
The school is obliged to provide the student with full-fledged conditions for study, this list includes:
- respect for the student;
- ensuring safety, including in physical education lessons;
- assistance of teachers in the learning process;
- providing access to the library with educational materials.
An educational institution may recommend a transfer to another school, but it has no right to refuse a student to receive an education on the spot. If the reason is in the baby’s abilities, then the teacher is obliged to convey this to the parents.
Violation of rights in educational institutions
Despite the obligation of the educational institution to provide free secondary education, almost all schools collect money from parents for repairs, curtains and gifts for teachers.
Another common departure from duty is to recruit schoolchildren to work. Duty in the classroom in the form of cleaning the premises, washing windows or collecting garbage in the school area should not be imputed to students. This violates not only constitutional rights, but also Art. 50, paragraph 14 of the Law “On Education”, which says that without the consent of the parents, children cannot be involved in work.
The most dangerous thing for a child is not so much the cleaning of the territory and physical education with a competent teacher, but the psychological pressure on the student during his studies. In an educational institution, a student often suffers from:
- unfair criticism;
- threats from the teacher;
- humiliation of dignity;
- excessive demands;
- negative characteristics;
- punishment in the form of isolation.
All these actions on the part of a teacher or school administration can be regarded as psychological violence. This is contrary to the Law “On Education”, this item is given special attention. If the kid talks about such actions on the part of the teacher, parents need to intervene, up to transferring to another school.
Parents should pay attention to the condition of their child attending school. The kid must know his rights and understand that his parents will ensure that they are respected.
