A place in kindergarten is not given, how to get it, failure to provide, compensation

Every child who has reached a certain age has the right to a place in kindergarten. This right is guaranteed to children by the Constitution of the Russian Federation. Unfortunately, in real life, it is not so simple with the placement of children in a preschool institution. Parents often have to overcome many obstacles before their child can finally begin social adaptation among peers.

What to do if a place in kindergarten is not provided

According to Art. 43 of the Constitution of the Russian Federation, every citizen has the right to receive preschool, general and secondary specialized education. Accordingly, no child can be deprived of this right. In order to use it, parents or legal representatives must apply to the municipality with an application of the established form.

A place in a kindergarten is guaranteed for children by the state

The term for consideration and satisfaction of the application is established by Art. 12 of the Federal Law of the Russian Federation “On the Procedure for Considering Applications of Citizens of the Russian Federation”. The issue must be considered within 30 days from the date of registration of the application.

If a place is not provided due to the lack of free places in a preschool institution, parents have the right to apply to the municipal authorities with a request to create additional places.

Reasonable reasons why they usually do not give a place in the kindergarten

According to the Model Regulations on Preschool Educational Institutions No. 2562 of 2011, kindergartens must ensure the upbringing, development and maintenance of children aged 2 months to 7 years.

Failure to provide a place in a preschool institution may serve as a reason for going to court

For admission, parents are required to submit the following documents:

  • a statement from parents or other legal representatives;
  • medical report on the absence of contraindications for visiting the institution;
  • documents confirming the identity of the applicants.

Accordingly, the only reasons for refusing to attend kindergarten children are: age up to 2 months. and after 7 years, as well as his state of health. At the same time, for children with poor health, with chronic diseases, there are specialized institutions focused on certain conditions of upbringing.

Monetary compensation for kindergarten

This cash payment is a form of material assistance allocated by the local administration for the upbringing and education of children who do not attend a preschool educational institution.

The law establishes the minimum amount of assistance:

  • 20% of the average monthly payment in a child care facility for 1 child;
  • 50% on the 2nd;
  • 70% for the 3rd child.

If local authorities refuse to pay such compensation, parents are advised to contact the Department of Education for an explanation of the reason for the negative decision.

How to get financial assistance for raising children at home

To obtain material support for children who cannot be provided with a place in a preschool institution, you should contact the local department of social protection of the population.

Legal representatives need to prepare the following documents:

  • an application of the established form for the provision of financial assistance;
  • birth certificates of children;
  • representative’s passport;
  • a certificate confirming the composition of the family;
  • health insurance policy for the mother (or other representative) and the child;
  • a certificate confirming that there are no places in the preschool institution;
  • a copy of the applicant’s bank account;
  • order to grant maternity leave to mother or work book.

Payments are made until the children turn 3 years old. After reaching 3 years of age, the calculation of compensation automatically stops, regardless of the availability of places in the preschool institution.
